This Privacy Policy explains how Kill Boring Dead collects, uses and handles personal information for the TheraBreath P.S. Your Breath Stinks campaign.

This campaign is operated by Kill Boring Dead for TheraBreath. Kill Boring Dead is the legal controller/collector of the personal information collected through this campaign.

This Privacy Policy applies only to personal information collected for this campaign.

Campaign Summary

This is a short-term, Australia-only promotional campaign running from 20 July 2026 to 20 October 2026, unless extended or ended earlier.

The campaign allows a person to nominate someone to receive a TheraBreath box or sample. Boxes are available while stocks last. If campaign boxes run out, eligible recipients may receive a formal letter and sample while stocks last.

The campaign is open to Australian residents aged 18 years and over.

How The Nomination Works

A nominator may submit a form to nominate another person.

After a nomination is submitted, the nominated recipient may be contacted by SMS and/or email to let them know they have been nominated.

Nothing will be sent to the nominated recipient unless they choose to take part, confirm their consent and provide their own delivery details.

A nominator cannot consent on behalf of the recipient, cannot provide marketing consent for the recipient, and cannot opt the recipient into future marketing.

Information We Collect From Nominators

When you nominate someone, we may collect:

  • your name
  • your email address
  • your phone number
  • your address, if required
  • the nominated recipient's name
  • the nominated recipient's email address
  • the nominated recipient's phone number
  • any optional message or nomination details you choose to provide

You should only provide another person's details if you have their permission to do so for the purpose of this campaign.

Information We Collect From Nominated Recipients

If you are nominated and choose to take part, we may collect:

  • your name
  • your email address
  • your phone number
  • your delivery address
  • confirmation that you want to participate
  • information needed to confirm eligibility, prevent duplicate sends and arrange delivery

Phone number and/or email address is required so Kill Boring Dead can contact you if delivery details are missing, incorrect or incomplete.

We do not intend to collect sensitive information.

How We Use Personal Information

We use personal information collected through this campaign only to:

  • receive and manage nominations
  • contact nominated recipients by SMS and/or email
  • send nominated recipients an SMS invitation through Twilio
  • confirm recipient consent
  • confirm eligibility
  • prevent duplicate nominations or repeat sends
  • arrange packing, fulfilment and delivery
  • send a TheraBreath box, sample, formal letter or related campaign item
  • contact recipients to resolve missing, incorrect or incomplete delivery details
  • manage campaign administration
  • respond to privacy requests
  • maintain the security and operation of the campaign
  • comply with legal obligations, if required

We will not use campaign personal information for future marketing.

Campaign personal information will not be added to Kill Boring Dead's CRM or TheraBreath's CRM.

Marketing Consent

This campaign is not intended to collect consent for future marketing. If you are nominated, the message you receive will relate to this campaign only. You will not be signed up to marketing because someone nominated you. If marketing is offered in future, it would need to be separate, optional and based on your own express consent.

Recipient Consent

If you are nominated, you do not have to take part.

You will only receive a TheraBreath box, sample, formal letter or related campaign item if you confirm that you want to participate and provide your own delivery details.

If you do not want to take part, you can ignore the message, decline using the method provided, or reply STOP to opt out of further SMS contact.

SMS Messages And Twilio

Kill Boring Dead may use Twilio to send SMS messages to nominated recipients.

Twilio will be used to send nominated recipients a message letting them know they have been nominated and inviting them to visit the campaign microsite to view details, privacy information and choose whether to accept their delivery.

The SMS message may read:

Psst! [Sender's Name] nominated you for a surprise delivery.

View details, privacy info, and/or accept your delivery at https://thismightbeawkward.com.

Suspicious? Fair. Check with [Sender's Name].

Sent by KBD. Reply STOP to opt out.

Twilio will not be used to collect postal addresses or delivery details. Postal details will be collected through the campaign microsite only if the recipient chooses to take part. To send the SMS, Twilio may process the recipient's phone number, the SMS message content, delivery information, communications logs and related technical or telecommunications data. Twilio may also work with telecommunications carriers and service providers to route and deliver SMS messages. Twilio is a global communications platform. Twilio's Privacy Notice says it may transfer data internationally, including through primary processing facilities in the United States, and uses safeguards for international data transfers.

SMS messages sent through Twilio will be used only for this campaign and not for future marketing.

Deduplication And Repeat Nominations

To keep the campaign fair, only one campaign box, sample or related item may be sent per eligible recipient, address, household, email address or phone number.

If someone is nominated more than once, we may use limited information such as name and phone number to identify duplicate nominations or registrations.

This information is used only for campaign administration and fulfilment.

Opt-Outs And Declines

If a nominated recipient opts out or declines to participate, Kill Boring Dead may retain their phone number for the limited purpose of recording the opt-out and avoiding further campaign contact.

This information will not be used for marketing.

While Stocks Last

TheraBreath boxes are available while stocks last. If boxes run out, eligible recipients may receive a formal letter and sample while stocks last. Receiving a nomination does not guarantee that a box, sample, formal letter or campaign item will be available.

Where Information Is Stored

The campaign microsite is expected to be built and hosted using Lovable. Campaign data will be collected through the microsite and stored in Lovable. Lovable states that Lovable Cloud supports regional data hosting in the EU, US and Australia. This campaign will use Australian hosting. Lovable also states that Lovable Cloud may store and process customer data on Supabase infrastructure and may use sub-processors and integrations to provide its services.

Who Can Access Campaign Information

Authorised members of the Kill Boring Dead team may access campaign information where needed to operate the campaign and ship parcels. TheraBreath will not have direct access to the campaign database.

Campaign information may be accessed, downloaded or exported by Kill Boring Dead only where needed for campaign fulfilment, delivery, administration or legal compliance.

Any downloaded or exported campaign information will be kept secure, used only for the campaign, and deleted once it is no longer needed.

Shipping And Fulfilment

Kill Boring Dead will pack and ship the campaign boxes, samples, formal letters or related campaign items. Delivery will be arranged through Australia Post and/or Shippit. Recipient details may be uploaded into Australia Post and/or Shippit's platform for the purpose of creating shipping labels and arranging delivery. Tracking emails or SMS messages will not be sent as part of the campaign. If a parcel cannot be delivered, it will be returned to Kill Boring Dead's office at 29 Cromwell St, Collingwood, VIC. If delivery details are incorrect or incomplete, Kill Boring Dead may contact the recipient by email or phone to confirm the correct details.

Data Exports

Campaign data may be exported from Lovable as a CSV file by authorised Kill Boring Dead team members only.

CSV exports will be used only for fulfilment and delivery purposes, including uploading shipping details to Australia Post and/or Shippit.

CSV files will be stored locally on a password-protected office computer, with access limited to authorised Kill Boring Dead team members.

Campaign data will not be emailed, uploaded into a CRM, used for future marketing, or used for reporting.

Sharing With Service Providers

We may share personal information with service providers only where needed to operate, host, secure, administer or fulfil the campaign.

These service providers may include:

  • Lovable and related hosting/infrastructure providers
  • Twilio, for sending nomination SMS messages
  • telecommunications carriers and service providers used to deliver SMS messages
  • technical support providers
  • email providers, if used
  • Australia Post
  • Shippit
  • fulfilment, packing and delivery providers
  • security or administration providers, where required

Service providers should only use campaign personal information for the services they provide for this campaign.

We do not sell campaign personal information.

Retention And Deletion

Campaign personal information will be kept only for as long as needed to operate, administer and fulfil the campaign, and no longer than 90 days unless a longer period is required by law.

Campaign data will be deleted at the end of the campaign in October 2026, and in any event no later than 90 days after collection unless legally required to keep it longer.

Deletion will be handled by the Kill Boring Dead team and will include:

  • Lovable/Supabase records
  • CSV exports
  • shipping files
  • Australia Post and/or Shippit upload files, where available to Kill Boring Dead
  • local downloads
  • test data

No campaign personal information will be retained after the 90-day period unless legally required.

Access, Correction And Deletion Requests

You may request access to, correction of, or deletion of your campaign personal information by contacting: privacy@killboringdead.com

We may need to verify your identity before responding to a request.

In some cases, we may need to keep limited information where required for legal, security or administrative reasons.

If you make a privacy complaint, we will review it and aim to respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Electronic Messages

If we contact a nominated recipient by SMS or email, the message will relate to this campaign only.

The message should identify the sender, explain why the recipient is being contacted, include contact details, and include a way to opt out or decline further campaign contact where required.
